You own your data. We provide the platform. You agree to use it responsibly. We agree to keep it secure and available. Either party can terminate with 30 days notice. We offer a 30-day free trial with no credit card required.
1. Agreement
These Terms of Service ("Terms") govern your access to and use of the Governa platform, including the web application at app.governa.co.ke, mobile applications, APIs, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.
2. Your Account
You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information when creating an account. You must be at least 18 years old to use the Service.
3. Your Data
You retain all rights to the data you and your organisation upload, create, or store in the Service ("Your Data"). We do not claim ownership of Your Data. We process Your Data solely to provide and improve the Service, as described in our Privacy Policy.
4. Service Availability
We aim to maintain 99.9% uptime for the Service. We will provide reasonable notice for planned maintenance. Enterprise and Sovereign plans include custom SLA terms. We are not liable for downtime caused by factors outside our control.
5. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose, (b) attempt to access other tenants' data, (c) reverse-engineer the Service, (d) transmit malware or interfere with the Service's operation, or (e) resell the Service without written agreement.
6. Billing
Paid plans are billed monthly or annually as selected. Prices are in USD or KES as displayed at the time of purchase. We may adjust pricing with 30 days notice. You may cancel at any time; cancellation takes effect at the end of the current billing period.
7. Termination
Either party may terminate with 30 days written notice. Upon termination, you may export Your Data for 90 days. After 90 days, Your Data will be permanently deleted. We may terminate immediately for material breach of these Terms.
8. Limitation of Liability
To the maximum extent permitted by law, Governa's total liability under these Terms is limited to the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9. Governing Law
These Terms are governed by the laws of Kenya. Disputes will be resolved through arbitration in Nairobi, Kenya, under the rules of the Nairobi Centre for International Arbitration.
